City Center West Commercial and City Center West Residential General Explanation
City Center West Commercial Metropolitan District (“Commercial District”) and City Center West Residential Metropolitan District (“Residential District”) are Title 32 Special Districts that have been established for the purpose of financing and installing street, park and recreation, water, sanitation, transportation, mosquito control, and safety protection of the Districts; and all other improvements or services permitted by Article 1, Title 32, C.R.S. (collectively, the “Public Improvements and Services”), except as specifically limited by the Second Amended and Restated Consolidated Service Plan for the Districts approved by the City Council of the City of Greeley, Colorado on August 16, 2016, as it may be amended from time to time (the “Service Plan”).
The Public Improvements and Services are for the use and benefit of the residents and taxpayers of the Districts. The Districts are located in the City of Greeley, Weld County, Colorado. The Districts are quasi-municipal political subdivisions of the State of Colorado authorized to provide specialized services that the City of Greeley does not provide.
The Districts combined, along with City Center West Residential Metropolitan District No. 2, may incur an aggregate maximum debt of $20,000,000. Ad valorem property taxes, specific ownership taxes, payment in lieu of taxes (“PILOT”) revenues, fees, and any other legally available moneys may be used to repay such debt.
The Districts may assess, as adjusted for statutory or legislative changes occurring on or after January 1, 2007, a maximum mill levy of fifty (50) mills to repay such debt. Once imposed, the debt service mill levy imposed by the Residential District may only be imposed for forty (40) years, unless a majority of the board of directors of the Residential District has voted in favor of a refunding of a part or all of the debt and such refunding will result in a net present value savings, as set forth in Section 11-56-101, C.R.S., et. seq. In addition, the Districts may assess, as adjusted for statutory or legislative changes occurring on or after January 1, 2007, a maximum operations mill levy of ten (10) mills.
The Districts must file an Annual Report to the City Clerk of the City of Greeley, the Weld County Clerk and Recorder, the Division of Local Government, and the State Auditor.
Although the boundaries of the Commercial District and the Residential District do not overlap, both Districts’ boundaries overlap with the boundaries of AIMS Junior College, the City of Greeley, High Plains Library District, Northern Colorado Water Conservancy District, Greeley 6 School District, and Weld County.
